Terms of Service

1. Agreement to Terms

By accessing or using Ridafleet (“Platform”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. These terms apply to all visitors, registered users, vehicle hosts, and renters.

2. What Ridafleet Is

Ridafleet is a peer-to-peer marketplace that connects vehicle owners (“Hosts”) with individuals seeking to rent vehicles (“Renters”). Ridafleet is not a party to any rental transaction. We do not own, operate, insure, inspect, or control any vehicle listed on the Platform.

Ridafleet does not process, hold, guarantee, or facilitate any payment between Hosts and Renters. All financial arrangements — including daily rates, security deposits, and any other fees — are agreed upon and settled directly between Host and Renter outside the Platform.

3. Accounts

You must be at least 18 years old and hold a valid U.S. driver's license to register as a Renter. You must provide accurate, current, and complete information when creating an account and keep it updated. You are responsible for all activity that occurs under your account and for maintaining the confidentiality of your credentials.

We reserve the right to suspend or terminate any account that violates these Terms, engages in fraudulent activity, or poses a risk to the safety of the community.

4. Identity Verification (KYC)

Renters are required to complete identity verification (“KYC”) before booking a vehicle. This process may include submitting a government-issued photo ID and a selfie. By submitting KYC documents, you consent to their review by Ridafleet staff. Verification approval is at our sole discretion and is not guaranteed.

5. Host Responsibilities

  • Hosts must own or have the legal authority to list any vehicle on the Platform.
  • Vehicle listings must be accurate, including photos, condition, mileage, and features.
  • Hosts are solely responsible for ensuring their vehicles are roadworthy, legally registered, and adequately insured at all times.
  • Hosts must disclose any known defects, damage, or limitations that may affect a Renter's use of the vehicle.
  • Hosts set their own daily rates, security deposit amounts, and rental agreement terms.
  • Hosts are responsible for collecting payment and deposits directly from Renters.

6. Renter Responsibilities

  • Renters must hold a valid U.S. driver's license and be at least 18 years old.
  • Renters must operate vehicles lawfully and in accordance with the Host's rental agreement terms.
  • Renters are responsible for any traffic violations, tolls, fines, or fees incurred during their rental period.
  • Renters must return the vehicle in the same condition it was received, subject to normal wear and tear.
  • Renters are responsible for arranging payment, security deposits, and any additional charges directly with the Host.
  • Ridafleet does not provide insurance for any rental. Renters should confirm adequate insurance coverage before renting.

7. Rental Agreements

The Platform provides tools to generate digital rental agreements between Hosts and Renters. These documents are provided as a convenience and represent agreements solely between the Host and Renter. Ridafleet is not a party to any rental agreement and makes no representations about its enforceability. Users are encouraged to consult a legal professional regarding their agreement terms.

8. Payments

Ridafleet does not charge platform fees to Hosts or Renters. The daily rate listed is the full rate agreed between Host and Renter. Ridafleet does not process, hold, transfer, or guarantee any payments. All payment methods (cash, Zelle, Venmo, CashApp, bank transfer, or other arrangements) are agreed upon exclusively between Host and Renter.

Ridafleet may provide a payment records feature for Hosts to log transactions for their own reference. These records are self-reported and are not verified by Ridafleet. They do not constitute receipts, guarantees, or financial statements.

9. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable laws.
  • List vehicles you do not own or are not authorized to rent out.
  • Provide false, misleading, or fraudulent information in listings, profiles, or during verification.
  • Use vehicles for illegal purposes, street racing, or any activity prohibited by the Host's rental terms.
  • Attempt to scrape, reverse engineer, or exploit the Platform in any unauthorized manner.
  • Harass, threaten, or harm other users.
  • Create multiple accounts to circumvent a suspension or ban.

10. Disclaimers

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. RIDAFLEET DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

RIDAFLEET MAKES NO REPRESENTATIONS ABOUT THE ACCURACY, RELIABILITY, QUALITY, OR SUITABILITY OF ANY VEHICLE LISTING, USER, OR RENTAL TRANSACTION ON THE PLATFORM. ALL TRANSACTIONS ARE UNDERTAKEN AT YOUR OWN RISK.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, RIDAFLEET AND ITS OFFICERS, EMPLOYEES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, ANY RENTAL TRANSACTION, VEHICLE CONDITION, PAYMENT DISPUTE, ACCIDENT, INJURY, OR LOSS — EVEN IF RIDAFLEET HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL RIDAFLEET'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) FIFTY DOLLARS ($50) OR (B) THE AMOUNT YOU PAID TO RIDAFLEET, IF ANY, IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Ridafleet and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Platform, your rental transactions, your violation of these Terms, or your violation of any third-party rights.

13. Intellectual Property

All content, trademarks, logos, and software on the Platform are the property of Ridafleet or its licensors. You may not reproduce, distribute, or create derivative works without our prior written consent. You grant Ridafleet a non-exclusive, royalty-free license to display content you submit (such as vehicle photos and listing descriptions) solely for the purpose of operating the Platform.

14. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Texas, and you consent to personal jurisdiction in those courts.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date above. Continued use of the Platform after changes are posted constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
